I am requiring a short-term rental agreement that will need to be reviewed and agreed to prior to stay. It includes rules and "hold harmless agreement required by HOA.

Short term rental agreement
1. Identification of Landlord and Tenants. This Agreement is made and entered into on,___________________ between _________________ _guest/tenant
and Landlord. Tenant is liable for the payment of rent and performance of all other terms of this Agreement.
2. Identification of Premises and Occupants. Subject to the terms and conditions set forth in this Agreement, Landlord rents to Tenant, and Tenant rents from Landlord, for residential purposes only, the furnished one bedroom studio located in Arnold, California. The premises will be occupied by the undersigned Tenant only.
3. Limits on Use and Occupancy. The premises are to be used only as a private residence for Tenant, and for no other purpose. Occupancy by guests is prohibited without Landlord's written consent and will be considered a breach of this Agreement.
4. Defining the Term of the Tenancy. The term of the rental will begin on __________, 2020 and expire on ___________2020
5. Payment of Deposits. Landlord may withhold only that portion of Tenants' security deposit necessary to: (1) remedy any default by Tenants in the payment of rent; (2) repair damages to the premises exclusive of ordinary wear and tear; (3) clean the premises if necessary to restore it to the same level of cleanliness it was in at the beginning of the tenancy; and (4) remedy any default by tenants, under this agreement, to restore, replace, or return any of Landlord’s personal property mentioned in this agreement, including but not limited to the property referred to in Clause 11.
6. Utilities. Owner will be responsible for payment of all reasonable utility charges, except for garbage which is disposed at local transfer station for free.
7. Prohibition of Assignment and Subletting. Tenants will not sublet any part of the premises or assign this Agreement.


8. Condition of the Premises. Tenants agree to: (1) keep the premises clean and sanitary and in good repair and, upon termination of the tenancy, to return the premises to Landlord in a condition identical to that which existed when Tenants took occupancy, except for ordinary wear and tear; (2) immediately notify Landlord of any defects or dangerous conditions in and about the premises of which they become aware; and (3) reimburse Landlord, on demand by Landlord, for the cost of any repairs to the premises, including Landlord’s personal property therein, damaged by Tenants or their guests or invitees through misuse or neglect.
9. Pets. No animal, bird, or other pet may be kept on the premises without owner approval.
10. Landlord's Access for Inspection and Emergency. Landlord or Landlord's agents may enter the premises in the event of an emergency or to make repairs or improvements, supply agreed services, and conduct an initial move-out inspection requested by tenant. Except in cases of emergency, Tenants' abandonment of the premises or court order, Landlord will give Tenants reasonable notice of intent to enter. The notice will include the purpose, date and approximate time of entry.
11. Prohibitions Against Violating Laws and Causing Disturbances. Tenant will be entitled to quiet enjoyment of the premises. Tenant and or invitees will not use the premises or adjacent areas in such a way as to: (1) violate any law or ordinance, including laws prohibiting the use, possession or sale of illegal drugs; (2) commit waste or nuisance; or (3) annoy, disturb, inconvenience or interfere with the quiet enjoyment and peace and quiet of any other tenant or nearby resident.
12. Repairs and Alterations
a. Tenants will not, without Landlord's prior written consent, alter, re-key or install any locks to the premises or install or alter any burglar alarm system.
b. Except as provided by law or as authorized by the prior written consent of Landlord, Tenants will not make any alterations to the premises. Landlord will not unreasonably withhold consent for repairs, but will not authorize repairs that require advanced skill or workmanship or that would be dangerous to undertake.
13. Damage to the Premises. In the event the premises are partially or totally damaged or destroyed by fire or other cause, the following will apply: Notice will be given to Tenant terminating this Agreement at any time after such damage, and specifying the termination date; in the event that Landlord gives such notice, this Agreement will expire and all of Tenants' rights pursuant to this Agreement will cease.
a. In the event that Tenants, or their guests or invitees, in any way caused or contributed to the damage of the premises, Landlord will have the right to terminate this Agreement at any time, and Tenants will be responsible for all losses, including, but not limited to, damage and repair costs as well as loss of rental income.
b. Landlord will not be required to repair or replace any property brought onto the premises by Tenants.
14. Tenants' Financial Responsibility and Renters' Insurance. Tenant agrees to accept financial responsibility for any loss or damage to personal property belonging to Tenant and their guests or invitees caused by theft, fire or any other cause. Landlord assumes no liability for any such loss. Landlord recommends that Tenants obtain a renters/travelers insurance policy from a recognized insurance firm to cover Tenants' liability, personal property damage and damage to the premises.
15.Payment of Attorney Fees in a Lawsuit. In any action or legal proceeding to enforce any part of this Agreement, the prevailing party [X] will not/ [ ] will recover reasonable attorney fees and court costs.

16. Additional Provisions
1. Walkthrough will be completed on move-in day, and any concerns turned over to landlord immediately.
2. Tenant agrees to check smoke detectors regularly and replace batteries as needed.
3. Tenant will be supplied door code and a copy of supplemental information and agrees to review Cabin Handbook information and rules/regulations

4. Tenant understand recommendation to use surge protectors for computers, TV’s, and all electronic equipment. Landlord is not responsible for possible damage as a result of power surge.
5. Tenant understands possibility of extended power outages out of the control of owner, and will have option to vacate .
6. Guests are prohibited from smoking in the house.
7. Garbage disposal: There is no garbage disposal. Food, Fibrous material and grease, etc. shall be disposed of in the garbage.
8. Shower: Recommend using daily shower spray like Tilex to help prevent water and mildew stains. Tenant agrees to keep window slightly open to vent steam to help prevent water and mildew.
9. Toilets: Due to low flow sewer system, only toilet paper in small amounts shall be are allowed to be flushed. No hair, babywipes, wetwipes, napkins, tampons, tissue, etc. If sewer backup occurs due to negligence of tenant, tenant will incur the cost to remedy.
10. Care of premises: Tenant agrees to maintain home in a clean and orderly fashion.
11. Tenant has been made aware that Internet can be intermittent and unreliable at times.
12. Garbage can be disposed for free at the Avery dump
13. Rental Rules: Guest/tenant agrees to abide by the Rental Rules attached as Exhibit A at all times while at the property and shall cause any quests permitted on the property to abide by the rules at all times while at the property and agrees to comply with all rules and regulations required by owner and HOA & are subject to provisions of CCR’s.
17. PERSONAL PROPERTY AND INJURY:
Occupant’s personal property, including vehicles, are not insured by Owner or HOA,
against loss or damage due to fire, theft, vandalism, rain, water, criminal or negligent acts of
others, or any other cause. Owner does not insure against personal injury to Occupant, guests or
licensees. Occupant agrees to indemnify, defend and hold harmless Owner or Owner’s Representative,HOA, from all claims, disputes, litigation, judgments, costs and attorney fees resulting from loss, damage or injury to Occupant, Occupant’s guests or licensees or their personal property.
If the premises are a concern or damaged upon move-in, Guest shall inform Homeowner immediately.




18. State Database Disclosure. Notice: Pursuant to Section 290.46 of the Penal Code, information about specified registered sex offenders is made available to the public via an Internet Web site maintained by the Department of Justice at megans law. Depending on an offender's criminal history, this information will include either the address at which the offender resides or the community of residence and ZIP Code in which he or she resides.
19. Grounds for Termination of Tenancy. The failure of Tenant or Tenant's guests or invitees to comply with any term of this Agreement, or the misrepresentation of any material fact on Tenant's Rental Application, are grounds for termination of the tenancy
20. Entire Agreement. This document constitutes the entire Agreement between the parties, and no promises or representations, other than those contained here and those implied by law, have been made by Landlord or Tenants. Any modifications to this Agreement must be in writing signed by Landlord and Tenants. The failure of Tenants or their guests or invitees to comply with any term of this Agreement is grounds for termination of the tenancy, with appropriate notice to tenants and procedures as required by law.

EXHIBIT A
RENTAL RULES

1.Smoking is allowed outside only. Use caution to prevent fires No smoking or fires is allowed on the Premises. If smoking does occur on the premises, guest is responsible for all damage caused by the smoking including, but not limited to, stains, burns, odors and removal of debris; Occupant is in breach of this Agreement; and forfeits right to return of any security deposit

2.People other than guest/tenant above may not stay at the property and need my prior approval. Any other person in the property is the sole responsibility of Guest. At no time are parties permitted. Guest/tenant will be considered in breach of this Agreement, and forfeits right to return of any security deposit. Owner is not responsible for any accidents, injuries or illness that occurs while on the premises or its facilities. The Homeowner is not responsible for the loss of personal belongings or valuables of the guest. By accepting this rental agreement, it is agreed that guest/tenant is expressly assuming the risk of any harm arising from their use of the premises or others whom they invite to use the premise.

3.Keep the property and all furnishings in good order. Guest/tenant shall not make any alterations in or about the Premises including, but not limited to, moving furniture. Only use appliances for their intended uses

4..Pets are NOT allowed .If an unauthorized pet is on the Premises, guest/tenant is responsible for all damage caused by the pet. Occupant is in breach of this Agreement, and forfeits right to return of any security deposit.

5.Housekeeping: There is no daily housekeeping or laundry service. Linens and bath towels can be included but will need to be washed by guest/tenant at laundromat.
. We expect and appreciate the house be left in the condition it was found. To avoid additional clean up fee, please be mindful of the following- GARBAGE: Please collect and place garbage bags in large brown garbage bag. Tied bag can be taken and dispose of (at no charge) at the Avery Refuse Disposal Transfer Station. REFRIGATOR: Please clean out unused food and discard or take with you when checking out.
6.Septic: The septic system is very effective; however, it will clog up if improper material is flushed. DO NOT FLUSH anything other than toilet paper. No feminine products should be flushed at anytime. If it is found that feminine products have been flushed and clog the septic system, you could be charged damages of up to cost to repair

COMMON AREA USE HOLD HARMLESS AGREEMENT

I understand the risks involved in using the Pinebrook provided facilities and in being physically present on Pinebrook subdivision property, roads and trails, and l accept any and all responsibility for myself,, my
family, my guests, including but not limited to property damage or loss, minor bodily injury, severe bodily injury, and death. ln consideration of my participation and representative of family and guests
to the fullest extent permitted by law, I agree to indemnify, defend and hold harmless the owners, the Pinebrook HOA, its officers, directors, employees, volunteers, and assigns from and against all claims arising out of or resulting from said participation for myself and all those that I represent; family and guests ('Claim as used in this agreement means any financial loss, claim, suit, sickness, disease or
death, or injury to or destruction of tangible property including loss of use resulting therefrom. ln addition, I hereby voluntarily hold harmless the owners Pinebrook HOA, its officers, directors, employees, volunteers, and assigns from any and all claims, both present and future that may be made by me, my family, and guests,
I also understand that the owners, Pinebrook HOA does not provide any medical or dental insurance or life insurance to cover bodily injury, illness or death, nor insurance for personal property damages or loss, nor insurance for liability arising out of negligent acts or omissions; and I acknowledge that I am completely responsible for my own insurance to cover these expenses for myself, my family, and my guests.
I further understand that this acknowledgment of risk and hold harmless is intended to be as broad and
inclusive as permitted by the laws of the State of California and that if any portion hereof is held invalid, I
agree that the balance shall, notwithstanding, continue in full legal force and effect. ln the event any
claims or suit is brought forward within the scope of this agreement by myself, my family members, or my
guests, or on behalf of any of the fore-mentioned, I agree to pay for all legal
fees and costs associated with the defense of such claims or suit incurred by the owners, Pinebrook HOA, its officers, directors, employees, volunteers, and assigns.
