All guests staying at Château du George are required to purchase a property damage protection insurance policy prior to receiving approval to rent. Your host is happy to give you more details regarding this policy upon inquiry.

Rental Contract:

By reserving this unit, you are acknowledging and agreeing to the following Rental Agreement for this specific property. It is a legally binding contract so you must read it carefully:

DEFINITIONS For the purposes of this Reservation Agreement (the "Agreement") the following definitions will apply:

"Owner" refers to the legal owner of the Premises. “Host” refers to the legal individual(s) responsible for oversight of the premises. "Premises" refers to the real property, its contents and related amenities rented to the Guest pursuant to this Agreement. "Guest" refers to the person or persons occupying the Premises; and "Rental Term" refers to the term of the Agreement.

Guest acknowledges that the Premises is privately owned. The Premises shall be used for residential vacation rental purposes only. NO PETS ALLOWED. Special events, i.e., parties, receptions, etc. shall not be allowed without the express written permission of the Host(s). It is mandatory to disclose the exact number and names of Guests (subject to maximum) who will be occupying the Premises during the Rental Term, or any portion thereof. If the number of occupants changes, Guest(s) must immediately notify the Host(s), in writing of said change. Additional charges may apply. In no event, however, shall the Premises be sublet.

1. BOOKING TRANSACTION – You are entering into a rental agreement directly with the Owner (hereon, “Host”) of this Vacation Rental (hereon, “the Premises”) you are booking.

2. SERVICES: No services are required to be performed by the Host(s) as part of this rental agreement. This is a rental contract only. This property has some form of high- speed internet access. Interruptions to this service can occur. Neither interruption/reduction of high-speed internet access nor incompatibility with Guest’s electronic devices will be reason for refund or relocation. Advertised amenities are subject to change without notice or compensation. Changes can occur after a reservation is made as a result of sale of property, remodeling, mechanical failure or servicing of property.

3. PAYMENT TERMS & CANCELLATION – a portion of the total fee is collected at booking prior to your stay. You may cancel your booking at any time; however, all amounts paid are subject to the payment terms Guest booked under. Unless otherwise stated, all cancelations are non-refundable. No exceptions are made. Guest(s) are strongly advised to acquire rental insurance.

4. HOUSE RULES – A) No large groups, parties, pets, fires or smoking is allowed in or around the Premises. Barbeques are only permitted on the Premises in the designated area outside. Guest(s) assume(s) full responsibility and liability when using any amenities or devices in the unit. If Guest(s) is/are unsure about a use or operation of any amenity or device in the unit, Guest(s) agree(s) not to utilize or operate amenity or device. Guest(s) also agree to never allow minors to utilize or operate any amenities or utilities on the Premises. B) Excessive noise or any noise outside of “Quiet Hours” of 7 PM to 10 AM is not permitted. C) Guest(s) agree(s) not to enter areas extending beyond property. If Guest(s) is/are unsure about property limits, Guest(s) agree(s) to contact Host(s) for clear definition of property boundaries. Guest(s) assume(s) full responsibility of damages, liabilities or other dangers outside of property grounds. D) No unsupervised minors permitted on property at any time. Guest(s) assume(s) full responsibility for minors and their conduct at all times.

5. ARRIVAL DETAILS & CHECK-IN/CHECK-OUT – Utilizing access code and/or entering the property in any way shall be considered a “check-in” which shall occur no earlier than the start of the rental contract period which is 2 PM (unless otherwise stated in writing by Host(s)) on your check-in date per the booking documents. This includes going to the unit before 2 PM to “drop off luggage” which is a violation of this agreement. Check-out shall occur no later than 11 AM on your date of departure per the booking documents, which means you and your personal effects shall be removed from the unit by you by 11 AM. Guest(s) understand property security systems activate at the conclusion of rental agreement at 11 AM sharp. Guests exceeding the check-out time may activate security system. Guest(s) accept full responsibility for any costs incurred due to security system activation. No exceptions are made (unless stated in writing by the Host(s)) as the unit must be vacant for our maintenance crew to clean, review, and prepare the Premises. Housekeepers are not authorized to change these terms.

Booking Guest acknowledges that all Guest(s) are expected to read through the house manual immediately upon arrival. Any questions regarding manual, or additional questions regarding Premises will be directed to Host(s) immediately following check-in.

6. LOCK-OUT: Guest(s) agree to take full responsibility for any type of lock-out, whether accidental or otherwise. This means that should a lock-out occur, you will bear all fees for the service provided, including but not limited to any service charges, repairs, or any other charges as a result of the lock-out. You also agree to notify the Host(s) of what occurred.

7. MAXIMUM OCCUPANCY – The maximum number of people that may occupy the unit is 10. This rule applies to day visitors and children as well.

8. MAINTENANCE – The Owner(s) care(s) very much about the Premises and strive(s) to keep it in excellent condition. Guest(s) are required to immediately inform Host(s) of any problems associated with the Premises, including appliances, furnishings, jetted tub, tubs, and any other items. Host(s) shall undertake reasonable efforts to remediate any reported problems. However, no refunds will be given for inoperable furnishings, jetted tub, or other fixtures. If you notice any problems or maintenance issues, you agree to notify Host(s) immediately. Guest(s) agrees that the Owner(s)/Host(s) may enter the Premises for maintenance or for other purposes deemed necessary by Owner/Host(s). Twenty-four (24) hour notice will be given when possible, but no advance notice is required. If requested, you shall allow the Host(s) access to the Premises during your stay. The Host shall exercise this right of access in a reasonable manner, and determine exit time in a reasonable fashion.

9. CANCELLATIONS BY THE OWNER – In the event that the Owner(s) must cancel your booking for any reason you will be notified as quickly as possible and refunded 100% of any amounts paid. The Owner(s)/Host(s) highly recommend that you purchase trip insurance to protect against certain types of cancellations, such as missed flights or health issues, among many other unforeseen circumstances. Texas’ weather is unpredictable. Inclement natural conditions shall not serve to alter or cancel Guests’ obligations under this Agreement. Neither Host(s) nor Owner(s) are responsible for cancellations due to natural disaster, acts of God, civil unrest, terrorism, war or threat of war, or any other reason beyond Host(s) or Owner(s)’ control; Host(s) is/are not responsible for dissatisfaction with the accommodations and/or facilities; Guest(s) waive(s) any and all claims against Owner(s)/Host(s). Guest accepts full responsibility for the acts of their children, family, friends, visitors, or invitees at the expense of Guest, including injuries or death from the Premises or property. In lieu of prepaid deposits Guest(s) authorizes Host(s) to repair damages or losses caused by Guest(s), including Guest(s)’ family, friends, visitors or invitees at the expense of the Guest(s). Host(s) is hereby authorized to charge Guest's credit card(s) on file for any damages beyond normal wear and tear and/or for excessive cleaning required. Guest(s) will be responsible for all applicable taxes, security deposits, utility charges, personal expenses and any other fees/charges due to the rental property. Host(s) and/or Owner(s) is/are not responsible for any loss or damage Guest(s) may incur. Host(s) or Owner(s) is/are not responsible for injuries or fatalities due to use or occupancy of rental property buildings, grounds, equipment, jetted tub, tubs, stairs, amenities, etc.

10. CLEANLINESS – I have read and understand all house rules. In booking this Premises I agree that all Guest(s) will comply with house rules. I also understand that a copy of house rules can be found online or in the house manual. I affirm that Guests are expected to treat the Premises with respect, keeping in mind that this is a home, not a hotel room. Even though a cleaning fee is charged, Guest(s) are expected to leave the Premises in a clean, neat, and orderly condition. Dishes are not to be left in sink in the event that that cleaning staff might not arrive immediately. Any significant amounts of sand, mud, dirt or any other excessive lack of cleanliness is a violation of this agreement. Although Premises property is well-maintained, Texas harbors a wide variety of plant, animal, and insect life. Guest(s) may see more insects, wild-life, and lizards during occupancy of the Premises. Be advised this is commonplace and shall not warrant relocation or reimbursement of funds. Host(s) ensure that should plant, animal, or insect life be found within the property, they will exercise diligence in removing these entities from the Premises. Guest(s) understand that the welcome and spa baskets at the Premises are gifts for Guest(s), Guest(s) are under not obligation to take or use these items. Guest(s) are also responsible to read all labels on items found on the Premises. Guest(s) are responsible to ensure their own safety when choosing to utilize these items. Guest(s) agree to follow all labels and guidelines found on Premises. Guest agrees indemnify and hold harmless Host(s) and Owner(s) for any issues related to these items. Guest(s) also understand that unless stated no items are to be removed from the property. Removal of any items unless stated will be considered theft and result in additional charges not covered by the property damage protection policy. Guest(s) agree to cover all expenses for items removed from property.

11. INDEMNIFICATION & HOLD HARMLESS – Guest(s) agree to indemnify and hold harmless the Host(s) and Owner(s) for any liabilities, damage(s), cost(s) or expense(s) whatsoever arising from or related to any claim in connection with your use and/or occupancy of the Premises, including, but not limited to, any claim or liability for personal injury or death(s), damage(s), loss of personal belongings or theft of property which is made, incurred or sustained by you and/or anyone you invite to use the Premises as your guest. Booking guest assumes responsibility to relay all rental agreement information to all other Guests, and affirm their comprehension and compliance with Rental Agreement prior to their check-in on the Premises. This clause especially applies to children as our Premises has not been “child-proofed.” Although some steps have been taken for child safety. You and your guests hereby acknowledge this risk and agree to take all steps, ordinary and extraordinary, to ensure the safety of any children in the Premises which shall include, but not be limited to, you performing “child-proofing” practices in the Premises. Guest(s) maintain full responsibility for safety themselves, additional guests, and any and all minors.

12. ATTORNEY’S FEES & COSTS – If the Host(s) or Owner(s) employs the services of an attorney or attorneys to enforce any conditions of this Agreement, you shall be liable to the Host(s) and Owner(s) for reasonable attorney's fees and costs incurred by the Host(s).

13. FALSIFIED BOOKINGS – It is a violation of this agreement to book or reserve the Premises under false pretense, including, but not limited to, a falsified name, age or size of party.

14. DAMAGE – Guest who make booking agrees to procure a damage protection policy required by the Owner(s)/Host(s) at the time of booking. I hereby agree that Host(s) or Owner(s) may charge my credit card for damages in excess of the amounts covered by the damage protection policy. Guest who makes booking agrees to pay in full for costs in the event of the following: A) damage to property or furnishings, B) dirt or other mess requiring extra cleaning, C) any other costs incurred as a result of your stay, D) any forfeitures pursuant to this Agreement, E) costs affiliated with breach of house rules, including relocation of furnishings, damages, and more.

Any damage to the Premises must be reported to the owner before check-out. Any damage, accidental or otherwise, is the full responsibility of the guest who books the Premises. The guest who books the Premises hereby grants the Premises Owner(s)/Host(s) the right to charge the credit card number used to book the unit for any such damages not covered under the insurance policy procured at time of booking. To ensure that the proper party is held responsible, please notify the owner of any damages found at check-in.

15. VIOLATION OF THIS AGREEMENT: ANY violation of any terms to this rental agreement by Guest(s) may result in immediate assessment of consequential, punitive or other damages, and possible immediate eviction, all at the sole discretion of the Host(s)/Owner(s).

16. GENERAL TERMS – If any section, clause, paragraph or term of this Rental Agreement is held or determined to be void, invalid or unenforceable, for any reason, all other terms, clauses or paragraphs herein shall be severed and remain in force and effect. This Rental Agreement is taken in full compliance with federal, state and local Fair Housing Laws, without regard to race, color, religion, sex, country of origin, handicap or familial status.
